Vouch Club Terms of Service

By creating a Vouch Club account or using the app, you agree to these Terms. If you don't agree, don't use Vouch Club. Vouch Club is operated by Vouch Club Inc. ("Vouch Club", "we", "us").

1. Who can use Vouch Club

• You must be 18 or older (or the age of majority where you live, if that is higher).
• You confirm you have the legal capacity to enter into this agreement.
• You must be a real person using your own identity. No bots, no fake or impersonated profiles.
• One account per person.
• You must not be a previously banned user.

2. Age confirmation

The Service is strictly for adults aged 18 and over. We do not perform identity checks or "know your customer" (KYC) verification. Instead, when you sign up you must confirm, by ticking the acceptance box, that you are at least 18 years old (or the age of majority where you live, if that is higher). That confirmation is a binding representation by you that you rely on to access the Service.

By requiring this self-certification, we have taken the steps we reasonably can to keep people under 18 off the Service. To the fullest extent permitted by law, we are not responsible or liable for any harm, loss, or damage of any kind arising from any person who accesses or uses the Service while under 18 by providing false age information. You agree that responsibility for any such misuse rests entirely with the person who provided the false information. If we become aware that a user is under 18, we will remove their account.

3. Getting in

Vouch Club is access-controlled. You join through an invite code, an early-access code, or by being approved off the waitlist. Codes are personal and non-transferable.

4. Your content

• You keep ownership of the photos and content you post.
• By posting, you grant Vouch Club a limited, non-exclusive, royalty-free license to host and display that content within the app so Vouch Club can function. We don't claim ownership and we don't use your content for advertising.
• You're responsible for what you post and represent that you have the right to post it.

5. Rules of conduct

You agree not to: - Create fake profiles, catfish, or impersonate anyone - Harass, threaten, intimidate, or post hate speech - Post nudity or sexually explicit images - Send unsolicited images of any kind. Sending unsolicited sexual or explicit images ("cyber-flashing") is strictly prohibited, may be unlawful, and will result in removal - Spam, solicit, advertise, scam, or run any commercial scheme - Share other users' photos, messages, or personal information outside the app - Use Vouch Club if you've been banned, or attempt to evade a ban - Scrape, reverse-engineer, or abuse the app or its systems

See the Community Guidelines for the full version. Breaking these can get you a warning, get content removed, or get your account suspended or banned.

6. Safety: no background checks, your interactions are your own

Vouch Club does not conduct criminal background checks or identity verification on its users. We do not vet, screen, or vouch for the character, conduct, or intentions of anyone you meet through the app. Any profile review we perform is limited to checking that a profile appears real and meets our guidelines. It is not a background check and not an endorsement of any person. You are solely responsible for your interactions with other users, whether online or in person. Meet new people carefully, let someone know where you're going, and use the blocking and reporting tools we provide. To the fullest extent permitted by law, Vouch Club is not responsible for the conduct of any user, on or off the app.

Verification in the future. We may introduce identity-verification steps (for example confirming your email, phone number, or a face/photo check) and may require you to complete them to keep using some or all of the Service. If we do, we'll explain what's collected and how it's used before you complete the step. Declining may limit or end your access.

7. How Vouch Club works (and what we don't promise)

• Engagement and timers: how you use Vouch Club (showing up, replying within the timers, not ghosting) affects how often you're surfaced. This is by design.
• No guarantees: we don't promise matches, messages, or any particular outcome. Vouch Club is a place to meet people. What happens between you and another user, online or in person, is your responsibility, not ours.
• The Service is provided "as is" and "as available." We do not warrant that it will be uninterrupted, error-free, or secure.

8. Venue offers

Vouch Club shows offers from local businesses: a discount off your bill, a deal on a meal, that kind of thing. They're there to give you somewhere to go. Here's how they work and what we are and aren't responsible for.

The offer is between you and the venue. The business sets the offer and provides it. We publish it in the app and tell you where to find it. We don't own, run, staff, supply, or inspect any venue, and we aren't a party to whatever happens when you get there. You pay the venue directly, like any other customer. No money for an offer ever passes through Vouch Club.

Follow the venue's rules. Their house rules apply: dress code, minimum age, reservations, hours, how many people at a table, what their staff tell you. Venues can refuse service at their discretion, and a Vouch Club offer doesn't override that. Treat their staff and their space with respect. Behaviour that damages a venue's reputation, or ours, can cost you access to offers.

Offers change. An offer can be limited to certain days, capped at a number of redemptions, or end on a set date. Claiming one holds it for a limited time and then it expires. Offers can also sell out, be corrected, or be withdrawn at any time, including after you've claimed one, and we don't promise any particular offer will be available to you. Offers are personal to you, non-transferable, have no cash value, and can't be sold, traded, or combined with anything else unless the venue says so. Codes are for use in person at the venue.

What happens at a venue is the venue's responsibility. To the fullest extent permitted by law, Vouch Club is not responsible or liable for anything arising out of your visit to a partner business or your use of an offer. That includes the quality, safety, or accuracy of any food, drink, product, or service; illness or injury; damage to or loss of property; a venue that closes, changes its offer, or declines to honour it; and any dispute, act, or omission of the venue or its staff. Listing a business is not an endorsement of it and not a warranty about it. Any rights you have against a venue are yours to pursue with that venue.

If something goes wrong, tell us. Email us at the address in §12. We'll do our best to work it out with the venue, and we can remove a business from Vouch Club. That's a commitment to help, not an assumption of liability for the venue's conduct.

Your rights. Nothing in this section takes away any right you have under consumer protection or other law that cannot legally be waived.

9. Our rights

We may, at our discretion: - Remove content or suspend/ban accounts that break these Terms - Change, limit, or discontinue features - Add, change, or remove venue offers and partner businesses at any time - Update these Terms (we'll post changes and update the date; continued use means acceptance)

10. Disclaimers, limitation of liability and indemnity

Disclaimer. To the maximum extent permitted by law, Vouch Club disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability. To the maximum extent permitted by law, Vouch Club is not liable for indirect, incidental, special, or consequential damages, or for the conduct of any user. Where liability cannot be excluded, Vouch Club's total aggregate liability to you for any claim is limited to one hundred Canadian dollars (CAD $100).

Nothing in these Terms removes any right you have under consumer protection or other law that cannot legally be waived.

Indemnity. You agree to indemnify and hold harmless Vouch Club from any claims, losses, liabilities, or costs (including reasonable legal fees) arising from your use of the Service, your content, your conduct toward other users, or your breach of these Terms.

11. Governing law

These Terms are governed by the laws of the Province of Alberta, Canada, and you submit to the courts of Alberta for any dispute.
